LEGAL FRAMEWORK FOR MINING SECTOR IN MOZAMBIQUE

Accordingly, the mining sector is regulated by a legal framework that defends the use and exploitation of mineral resources in harmony with the best and safest mining practices. The prevailing legal framework for the mining sector in Mozambique is composed of several legal instruments, of which the following are noteworthy:

a) Resolution No. 89/2013, of December 31 - Mineral Resources Policy and Strategy;

b) Law No. 20/2014, of August 18 - Mining Law;

c) Law No. 15/2017, of December 28 - Specific Taxation and Tax Benefits Regime of Mining Activity;

d) Decree No. 26/2004, of August 20 - Environmental Regulation for Mining Activity;

e) Decree No. 61/2006, of December 26 - Regulation of Technical Safety and Health in Geological-Mining Activities;

f) Decree No. 31/2015, of December 31 - Regulation of the Mining Law;

(g) Decree No. 25/2015, of November 20 - Regulation of Marketing of Diamonds, Precious Metals and Gems;
